Your CONSERVATION COMMITTEE, to whom has been referred
SENATE BILL 22
has had it under consideration and reports same with recommendation that it DO PASS, amended as follows:
1. On page 19, line 6, after "treated", insert "domestic".
2. On page 29, line 17, strike "Exemptions" and insert in lieu thereof "Except as provided in Subsection U of this section, exemptions".
3. On page 29, line 19, after "farming", insert ", silviculture" and strike "as".
4. On page 29, strike line 20 in its entirety and insert in lieu thereof "such as plowing, seeding, cultivating, minor drainage, harvesting for the production of food, fiber and forest products or upland soil and water conservation practices;".
5. On page 29, line 23, strike "and".
6. On page 29, line 25, strike the period and closing quotation mark and insert in lieu thereof "; and".
7. On page 29, after line 25, insert:
"(4) a discharge composed entirely of return flows from irrigation.".
8. On page 30, before line 1, insert:
"U. The exemptions provided in Subsection T of this section shall not apply if the discharge of dredged or fill material resulting from the activities contains any toxic pollutant as set forth in rule by the commission or if a new activity brings a surface water of the state into farm production where the area of the surface water has not previously been used for farming."".
and thence referred to the JUDICIARY COMMITTEE.
